1. Copyright Infringement Notice

NanoFlick LLC ("NanoFlick") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the NanoFlick service that are reported to our designated agent.

3. Filing a DMCA Notice

If you believe that content available on or through the NanoFlick service infringes your copyright, please send a notification containing the following information to our designated agent:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., a URL or description).
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which NanoFlick may be found), and that you will accept service of process from the person who provided the original notification or their agent.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10–14 business days that they have filed a court action, we will restore the removed material.

5. Repeat Infringers

In accordance with the DMCA and other applicable law, NanoFlick has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. NanoFlick may also, at its sole discretion, limit access to the service or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

6. Good Faith

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
